Tony Schwartz: Wedding MC & DJ (hereinafter “I,” “myself,” “me”) is a wedding musical entertainment company. When we work together, I collect some information about you in order to provide the highest quality wedding entertainment experience possible.

I want you (hereinafter my “customers”, “clients,” “user(s)”) to know that your privacy is important to me. That is why I have created this Privacy Policy (the “Privacy Policy”) to help you understand what information I collect about my clients, how I use it, and what choices you have about it. Personal Information

Personal Information. Data that is capable of identifying an individual or household.

Aggregate Information. Aggregate Information is not Personal Information because it excludes data that could help someone identify which individual or household it relates to or describes. As such, my Privacy Policy does not restrict my use of Aggregate Information.

Information I May Collect

Information You Provide. You may voluntarily provide me with Personal Information through my website, www.tonyschwartzmcdj.com (the“Site”), such as when you request information, make a payment, request a contract, schedule an appointment, or leave me an online review.

When you access or use my Site, it is your choice whether you would like to provide me with this information. Just know that you may not be able to use certain aspects of my Site, such as scheduling an appointment, make a payment, requesting more information, etc., without providing some Personal Information.

Payments. If you make a payment through my Site, the transaction may be handled by third parties, such as Square and Stripe, who are responsible for processing your payment (“Payment Processors”). Payment Processors have their own privacy policies that apply to you. Please be sure to review them at the links provided during payment processing.

Credit Card Information. I need your payment or credit card information to process payments. This information includes your name, payment or credit card number, expiration date, billing address, authentication codes and related information as needed to complete your purchase.

Automatically-Collected Information. When you visit my site, I receive and store automatically-collected information about you such as the name of the domain and host from which you access the internet, the IP address of the computer you are using, the browser and operating system you are using, the date and time you access the Site, any search terms you used to find the Site, device identifiers and network information, and your actions in connection with the Site, among others.

Automatically-collected information, however, is not Personal Information unless I make an effort to combine it to identifying information, or if otherwise required by law. As such, this Privacy Policy does restrict my use of automatically-collected information.

Cookies. Cookies are strings of text that a website may store on your computer to keep track of your visits and activity. That’s the next section of my Privacy Policy.

Use Of Cookies

My Site creates session cookies to facilitate your visit, and they expire at the end of the session.

I may also use persistent cookies, which can remain on your device for much longer but they do not corrupt or damage your computer or computer files.

I use analytics and customization cookies, including third party cookies from services such as Google Analytics and Keap’s Infusionsoft, to gather information on how my Site is being used and to measure the popularity of my marketing campaigns. I use this data to learn about how you interact with my marketing efforts, including how many times the email is opened and/or clicked, the browser type used, operating system, user email program, etc. The cookie set by my service providers will remain on your hard drive 30 days after the last time you clicked on the coded link in the email, or until you delete it. I also use this data to help prevent fraud.

I may use social networking cookies to allow users to share my pages and content through third-party social networking websites, such as Facebook and Instagram, among others.

I may use targeting/advertising cookies to help me customize and regulate the advertisements you receive, provide you with tailored offers, and measure the effectiveness of my advertising. Please see the “Do Not Track” section below for more information regarding personalized advertisements and your “Do Not Track” options.

You can control the use of cookies at the individual browser level. If you reject cookies, you may still use my Site, but your ability to use some features or areas of my Site may be limited. Use Of Your Personal Information

Usage. I may use Personal Information obtained through my Site to do the following (unless doing so is restricted by law):

  • Communicate with you by email, regular mail, telephone, or mobile devices, about my services or product offerings;
  • Develop and deliver marketing emails with the assistance of third parties (see more information about marketing emails below);
  • Tailor your user experience;
  • Develop and display third-party content and advertising tailored to your interests on the Site (see more information about advertising below);
  • Enforce applicable written agreements and contracts between you, the Customer, and myself
  • Manage my business;
  • Notify you of changes to my services or product offerings;
  • Send you information you have requested;
  • Process entries to a contest or promotion;
  • Carry out obligations under any contract I have with you; or
  • Perform functions as otherwise described to you at the time of collection.

Storage. I generally store Personal Information only as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, maintain business records, and as required under applicable law.

Transfer. To fulfill your requests and operate my business, I may transfer your Personal Information from the United States to other countries or regions in connection with storage and processing of data. By using my Site and voluntarily providing me with your Personal Information, you consent to such storage, transfer, and processing.

Marketing Emails. I may use third party service providers, such as Infusionsoft, MailChimp or Gmail, to send my marketing emails. The emails may contain e-tags, which permits you to share the mail via certain social sites. In addition, the third parties that assist with my marketing emails may use pixel tags that help me send the email in a format you can read to allow me to know which emails you act upon and to better target the content of future emails. I also use these tags to track the aggregate number of emails read and whether any of the links in the email were accessed.

Advertisements. I also may use third party service providers, such as Facebook or Google, to serve and host my advertisements. You may receive my ads on these third-party sites. These third parties may use cookies to track the number of times my Site is accessed and whether the Site was accessed from the advertisement. You may opt out of receiving personalized advertisements from advertising companies that are members of the Network Advertising Initiative or who subscribe to the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising by visiting www.networkadvertising.org/choices and www.aboutads.info/choices.

Do I Share Personal Information With Others?

Sometimes I have to share Personal Information with others (such as when required by law), and other times I share Personal Information with third party service providers to enhance your experience using my Site and interacting with my business.

As such, below are the ways I may share Personal Information with others:

  • I may share Personal Information with third party service providers that perform services or functions on my behalf (see more information about service providers below).
  • I share Personal Information with Payment Processors to process payments.
  • I may share Personal Information with third parties, such as social media sites, so you can view my content through those sites.
  • I may share Personal Information as I believe is necessary to comply with applicable laws, statutes, or regulations, and/or to enforce this Privacy Policy, my written agreements and contracts, and to protect my rights and the rights of others.
  • I may have to share Personal Information if required by a court or government agency or to respond to a claim by you or a third party.
  • I may share Personal Information as part of a transfer of my assets, such as a merger or acquisition involving my parent company, Tony Schwartz Productions, LLC.
  • I may share Personal Information as you may otherwise request or agree.

Service Providers. I use third party service providers for specific business support services, which may involve access to Personal Information. Examples of such services include sending emails, conducting and administering promotions, executing surveys, providing customer service, performing business analysis, and processing payments. This Privacy Policy does not encompass the actions of service providers or other third parties, and I am not responsible for any additional information you may directly provide them.

Business Transactions. I may disclose your Personal Information as part of any merger, sale of company assets or acquisition, as well as in the event of an insolvency, bankruptcy or receivership. The recipient of Personal Information following such actions may have privacy policies that differ from those in this Privacy Policy. If this happens, I will notify you via email and/or a prominent notice on the Site, and you may opt-out of the use of your existing Personal Information.

Special Events. If you choose to participate in any of my special events (for example, a promotion, contest, or sweepstakes), I may share your Personal Information with those organizations participating in the applicable event.

Sharing With Other Companies. I may share your information with other companies or organizations. These companies and organizations may use the information I share to provide, or help other companies provide, offers to you, market products, services, or opportunities to you, and to perform data analytics regarding your use of my Site and services. These companies and organizations may also use cookies on my Site for the same general purposes identified in this Privacy Policy, including to improve their own marketing, products or services.

My Policy On Children’s Privacy

Your children’s privacy is very important to me. My Site is not directed at children, and I do not knowingly collect Personal Information directly from users under the age of 13 or from other websites or services directed at children.

I promise to not knowingly request or collect Personal Information from any child under age 13 without first obtaining the required parental consent in a manner consistent with the Federal Children’s Online Privacy Protection Act of 1998 (“COPPA”). California Residents

While not a California company, California law requires me to disclose additional information that relates to the privacy rights of California residents.

Do Not Track. Under Section 22575 of the California Business & Professions Code, website and online service providers are required to disclose whether they honor web browser “Do Not Track” settings. Tony Schwartz: Wedding MC & DJ does not support “Do Not Track” web browser settings. For more information about Do Not Track, please visit www.allaboutdnt.com.

Note that “Do Not Track” settings are available to and applied the same to non-California residents.

Requests About Disclosures of Personal Information. Effective January 1, 2005, California Civil Code Section 1798.83 requires businesses who have disclosed a California resident’s Personal Information (that was made available to the business for primarily personal, family, or household purposes) to a third party during the preceding calendar year to inform that California resident of the disclosure in writing, upon request.

CCPA. The California Consumer Privacy Act of 2018 (“CCPA”) provides California residents with specific rights regarding their Personal Information, including information that could be linked with or used to identify a person or household. California residents have the right under the CCPA and certain other privacy as data protection laws, as applicable, to exercise the following rights free of charge:

Right to access what Personal Information I collect about you/request disclosure of Personal Information I collect and share/request disclosure of categories of Personal Information sold You have the right to know:

  • The categories of Personal Information I have collected about you;
  • The categories of sources from which the Personal Information is collected;
  • My business or commercial purpose for collecting or selling Personal Information;
  • The categories of third parties with whom I share Personal Information, if any; and
  • The specific pieces of Personal Information I have collected about you.

Please note that I am not required to:

  • Retain any Personal Information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained;
  • Re-identify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered Personal Information; or
  • Provide the Personal Information to you more than twice in a 12-month period.
Right to opt-out of the sale of Personal Information sold or used for a business purpose In connection with any Personal Information I may sell or disclose to a third party for a business purpose, you have the right to know:

  • The categories of Personal Information about you that I sold and the categories of third parties to whom the Personal Information was sold; and
  • The categories of Personal Information that I disclosed about you for a business purpose.

You have the right under the CCPA and certain other privacy and data protection laws, as applicable, to opt-out of the sale of your Personal Information.

Right to request deletion of Personal Information Subject to certain exceptions set out below, on receipt of a verifiable request from you, I will:

  • Delete your Personal Information from my records; and
  • Direct any service providers to delete your Personal Information from their records.

Please note that I may not delete your Personal Information if it is necessary to:

  • Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of my ongoing business relationship with you, or otherwise perform a contract between you and me;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when my deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided I have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with me;
  • Comply with an existing legal obligation; or
  • Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.
Right to be protected from discrimination You have the right to not be discriminated against by me because you exercised any of your rights under the CCPA. This means I cannot, among other things:

  • Deny goods or services to you;
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Provide a different level or quality of goods or services to you; or
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that I may charge a different price or rate or provide a different level or quality of goods and/or services to you, if that difference is reasonably related to the value provided to my business by your Personal Information.

I collect this type of information from my job applicants.

For HR purposes and pre-employment review. People who apply for employment with me. I share this data with my service providers and with business partners, including those to whom you instruct me to send this information.
Inferences

I generate these internally.

To understand how users interact with my Site, to develop and offer more relevant and useful services and product offerings, and to improve the products and services I offer. People who use my Site, leave me a review, make a payment, request a contract, or send me an inquiry. I don’t share unless a service provider is contracted to analyze such inferences for me.

Sales of Personal Information. Based on the definition of “sell” under the CCPA and under current regulatory guidance, I do not believe I engage in such activity. I do allow certain companies to place tracking technologies like cookies and pixels on my Site, which allow those companies to receive information about your activity on my Site that is associated with your browser or device. These companies may use that data to serve you more relevant ads on my Site or others. Except for this kind of sharing, I do not sell any of your information. How to Exercise Your Rights. If you would like to exercise any of your rights as described in this Privacy Policy, please:

Please note that you may only make a CCPA-related data access or data portability disclosure request twice within a 12-month period.

If you choose to contact me directly to make a CCPA-related request, you will need to provide me with:

  • Enough information to identify you (e.g., your full name, address, and/or contract number);
  • Proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill); and
  • A description of what right you want to exercise and the information to which your request relates.

If I cannot verify your identity, I am not obligated to comply with requests related to Personal Information. Any Personal Information I collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

Changes To My Privacy Policy

From time to time, I may change or modify my Privacy Policy. When a revision is made, I will revise the “Last Updated:” date at the top of this page. If you have provided me with your email address, I may, but am not required to, attempt to notify you by that address of any material changes to how I use your Personal Information.
